  • A special category of workers is represented, pursuant to the European and national norms, by the professional maternal assistants. In accordance with Article 1 of the Government Decision No 679/2003, these are natural persons, legally certified, who ensure, through the activity they carry out at their home, the raising, care and education necessary for the harmonious development of the children they receive in placement or in their custody. Although maternal assistants carry out their activity under an individual employment contract (of a special nature), they do not benefit by all the rights in their fullness which the other workers have. Thus, they do not have the right, only restrictively and with permission, to weekly rest, days off or rest leave. This situation is justified by the superior interest of their mission, that of ensuring the raising, care and education of children, their integration without discriminations in the family of the assistants. This is the reason why the European Court of Justice (Grand Chamber) has ruled (in the Romanian Case C-147/17) that the activity of maternal assistant does not fall within the scope of Directive 2003/88.
  • Încheierea definitivă pronunțată de către judecătorul de drepturi și libertăți de la Judecătoria Sighetu Marmației, în conformitate cu dispozițiile art. 4886 alin. (7) din C.pr.pen., ne oferă prilejul comentariului de față. În speță, la data de 22 ianuarie 2018, persoana vătămată (constituită parte civilă) P.J. a depus plângere prealabilă la Parchetul de pe lângă Judecătoria Sighetu Marmației, solicitând efectuarea de acte de urmărire penală față de făptuitorii B.I., B.M. și C.V. pentru săvârșirea infracțiunii de degradarea terenurilor agricole, prevăzută de art. 107 din Legea nr. 18/1991, Legea fondului funciar, actualizată, raportat la dispozițiile art. 253 alin. (1) din C.pen. În susținerea plângerii, a menționat că la data de 3 ianuarie 2018 făptuitorii au trecut de mai multe ori cu atelajele proprietate personală trase de câte 2 cai, încărcate peste capacitate, peste terenul de natură fâneață pe care îl deține, împrejurări în care, sub greutatea încărcăturii, copitele cailor de tracțiune și roțile atelajelor au creat urme adânci în solul puternic îmbibat de apele pluviale, terenul agricol fiind degradat pe o suprafață de 900 mp.
  • The present study is dedicated to the approach from theoretical and practical perspective of the problem of instigation to commit an offence or to continue to commit an offence for the purpose of obtaining evidence in the context of using special investigative techniques. The problems presented are based on an ex post facto analysis, with applied character, by outlining some concrete hypotheses. There are highlighted aspects elaborated by the European Court of Human Rights by way of case law, but also relevant aspects from the national case law of Romania in order to identify the criteria for establishing the illegal nature of the activities of the criminal investigation bodies necessary to collect and provide evidence in the criminal trial. Likewise, there are presented and analyzed the conditions retained by the Strasbourg Court necessary to be fulfilled so that the activities of the state bodies do not exceed the scope of loyalty of administration of evidence. In addition, an attempt is made to delimit the instigation to commit offences from the legal activity of the undercover investigators in the context in which it has been authorized the use of the special method of investigation of using undercover investigators or collaborators, provided by the Criminal Procedure Code.
  • Every 3 months, calculated from the beginning of the liquidation, the judicial liquidator must submit to the creditors’ committee a report on the funds obtained from liquidation and from the collection of claims, as well as a distribution plan between the creditors, if necessary. The report and the plan shall be recorded at the registry of the tribunal and shall be published in the Bulletin of Insolvency Procedures. The report shall also provide the payment of his fee and of the other expenses provided in Article 159 (1) point 1 or of Article 161 point 1 of the Law No 85/2014, as the case may be. The report on the funds obtained from liquidation and from the collection of claims shall include, at least, the following: the balance in the liquidation account after the last distribution; the collections made by the judicial liquidator from the sale of each asset and from the recovery of the claims; the amount of the interests or of other incomes benefiting to the debtors’ fortune, as a result of keeping the undistributed amounts in bank accounts or by administering the assets existing in the debtor’s fortune; the total of the cash amounts existing in the liquidation account.
  • The study analyzes how it evolved the competence of the court of law to solve the review in the civil trial from the initial version of the Law No 134/2010 on the Civil Procedure Code to the amendment brought by the Law No 310/2018 for amending and supplementing the Law No 134/2010 on the Civil Procedure Code, as well as for the amendment and supplementation of other normative acts. The result of the study is reflected in the opinion according to which the court of law competent to solve the review in the civil trial had to remain, as a rule, the High Court of Cassation and Justice. Thus it would have been made a unitary interpretation and the contradictory solutions would have been avoided. Although in the versions of the Law No 134/2010 and until the adoption of the Law No 310/2018 the purpose of the review was to subject to the High Court of Cassation and Justice the examination, under the terms of the law, of the conformity of the contested judgment with the applicable rules of law, the supreme court has diverted this purpose, by admitting the exception of its material incompetence and declining to solve the reviews.
  • By the present study the author analyzes in a critical manner the modality of regulation of the mechanism of the compensatory review introduced by the provisions of the Law No 169/2017, which has amended the Law No 254/2013 on the execution of custodial sentences and of measures involving deprivation of liberty ordered by the judicial bodies during criminal trial. In this respect there are examined the case law of the European Court of Human Rights in the matter of the accommodation of detained persons and the premises that were the basis for the adoption of this regulation. Thus, it is noted that the legislator has set a higher standard than the one imposed by the European Court of Human Rights, which has ruled that, under certain conditions (the presence of ventilation, lighting and privacy, etc.), the accommodation in a detention space that ensures an area of between three and four square meters for each detainee is in accordance with Article 3 of the European Convention on human rights and fundamental freedoms. In addition, it is shown that the legislator did not insert in the national law the whole legal mechanism emphasized in the case law of the European Court of Human Rights, where a preventive means of appeal has been introduced, allowing the detained persons to file complaints to a judicial authority with regard to the material conditions of detention, as well as a compensatory means of appeal, which provides a reparation for the persons who have already been through a detention contrary to the Convention. Likewise, the author analyzes in a theoretical, but mostly practical manner, the modality to apply the compensatory review mechanism depending on the processual phase in which it is analysed its incidence, as well as the effects produced at the level of the institutions of substantive criminal law, making reference to the binding decisions pronounced by the High Court of Cassation and Justice and to the national case law.
  • Potrivit art. 342 alin. (6) C.pen., constituie infracțiune și se pedepsește cu închisoare de la 6 luni la 3 ani nedepunerea armei și a muniției la un armurier autorizat în termen de 10 zile de la expirarea perioadei de valabilitate a permisului de armă. Totodată, conform art. 112 alin. (1) lit. f) C.pen., bunurile a căror deținere este interzisă de legea penală sunt supuse confiscării speciale (cu notă parțial aprobativă). În cazul faptei prevăzute în art. 342 alin. (6) C.pen., cu privire la care s-a dispus o soluție de clasare întemeiată pe dispozițiile art. 16 alin. (1) lit. b) teza a II-a C.pr.pen., arma și muniția intră sub incidența confiscării speciale, în temeiul art. 112 alin. (1) lit. f) C.pen., în procedura reglementată de art. 5491 C.pr.pen., în ipoteza în care făptuitorul nu a depus arma și muniția la un armurier autorizat în termen de 10 zile de la expirarea perioadei de valabilitate a permisului de armă.   • Introducing Article 1282 (2) created a new dimension in the new Civil Code as regards the application of the groups of contracts, as well as the transmission of accessories with the main asset on the descending or even ascending line of the contract chain. At the same time, the text of the law is the legal basis for formulating a direct action in guarantee which, as we shall see in the present study, is in some cases complemented by other express texts of law referring to particular cases of transmission of a right to action within the group of contracts. In the present study, we attempted to make a comparative analysis between the assignment of contract and the assignment of ancillary contractual rights or obligations, since, although the two transactions are similar, it also presents many differences that need to be highlighted. At the same time, we made a brief leap in common law, as well as European law on the notion of assignment of contractual accessories. Though, the subject is far from being covered by the present study, we consider that we have reached the main points on what Article 1282 (2) in the new Civil Code establishes, as well as its practical effects, and the comparative perspective with English, Scottish, Spanish, German and, last but not least, European law clarifies or strengthens some aspects as regards the rationale for the introduction of the text.
  • The legal liability is one of the main issues regarding the responsibility in administrative law. Therefore, the legal liability is able to exercise influence upon our society to some extent only by identifying the person responsible for ignoring the social values protected by law, in order to establish his/her liability. Let us stress upon the fact that the effectiveness of legal liability may determine, to a greater or a smaller extent, the establishment, re-establishment and even the survival of the rule of law. The society is more likely to take into consideration the legal liability, referring to the social and political background of these days, as well, if the liability is being applied to the civil servant or to an agent of public power, meaning a person who exercises a public function. What about the situation in which the person who is going to be held responsible for breaking the law and, therefore, being held liable for this fact is, directly or indirectly, even the creator of the law, being at the same time both part of the dominant fund and to the serviced/controlled fund? Does the above-mentioned situation supposes an antagonism in declaring responsible precisely the one who created the notion and, therefore, the premise of responsibility or, on the contrary, the antagonism would be precisely the irresponsibility of the entitled one, also, to create the right and to apply it, thus ensuring the protection of values, which establishes the base of its very existence?
  • As a rule, in the countries of the European Union, for example in France, Italy, Spain, England, the cancellation of the dismissal does not lead to the reintegration of the employees at work. However, they are entitled to compensation, to damages, etc. established by the judge within the limits provided by law. In our country the situation is different. Regardless of the reason for the dismissal, whether it is related or not to the employee’s person, the court, at his request, shall order, in case of cancellation of the employer’s measure, the reintegration at work, regardless of the fact that position exists or not, the position being abolished, or if the employee has committed serious disciplinary misconducts: he has systematically violated the work obligations, had an unexcused leave of absence for a long period of time, has purloined goods from the patrimony of the employer or caused important damages thereto, etc. There are considerations for which it is required the amendment of Article 80 (2) of the Labour Code, rendering it more flexible, in the sense of taking into account the present realities, the needs of the practice and the real and justified interests of the employers.
  • The herein study strives to concentrate the main theses developed by the Court of Justice of the European Union regarding the right to paid annual leave. Starting from these premises, it aims to detect the interferences and the effects of European jurisprudence on Romanian national law, with a special view on the practical protection of the right to paid annual leave, in both of its components, the entitlement to annual leave and to a payment on that account. The underlying of the carry-over period’s function represents the basis of the conclusions regarding the necessity for a rigorous distinction between the causes of non-exercise of the right to annual leave by the employee, consequently, reflecting in the different judicial solutions. From the point of view of the Romanian procedural law, the study underlines the need to amend the law regarding the limitation period of the right to action in court for the protection of the non-material component of the right analysed, in order to meet the imperative of full harmonization with the European law.
  • Based on art. 6 para. 1 of the (European) Convention of human rights and fundamental freedoms and art. 21 para. (3) of the Romanian Constitution (revised and republished), the author reviews numerous texts in the new (Romanian) Code of Civil Procedure (Law no. 134/2010, published in the Official Gazette of Romania, Part I, No. 485 of July 15th, 2010, yet unenforced), which implements, specifically, the principle of the right to a fair trial within optimal and predictable delay.
  • This study tends to be a partly critical analysis of the provisions of Article 117 of the Civil Procedure Code, and also an approach to bring to the attention of „doctrinarians”, „judges” and, especially, of the „legislator” the existence of a legislative gap in respect of the exclusive territorial jurisdiction of the courts in the situation that „disputes referring to real rights concern two or more estates located in the territorial districts of different courts”.
  • În peisajul jurisprudențial conturat după intrarea în vigoare a actualului Cod civil1, ne reține atenția o hotărâre2 pronunțată relativ recent de Secția a II-a civilă a Înaltei Curți de Casație și de Justiție a României în materia răspunderii civile delictuale a comitentului pentru fapta prepusului său, în funcțiile încredințate, care prin argumentele prezentate oferă o nouă perspectivă privind problematica atât de controversată din ultimele decenii privind natura juridică și fundamentul acestei ipoteze de răspundere. Deși datele speței se referă la o faptă ilicită săvârșită în anul 2005, fiind în discuție modul de interpretare a dispozițiilor art. 1000 alin. 3 din Codul civil din 1864, prin hotărârea pronunțată, Înalta Curte de Casație și de Justiție își însușește noua orientare propusă în doctrina noastră privind necesitatea recunoașterii caracterului direct, autonom și independent al răspunderii comitentului, în raport cu răspunderea prepusului său, precum și fundamentarea obiectivă a acestei răspunderi pe ideea de garanție, ideea de risc și ideea de echitate.
  • Comprised in the study presented hereafter, starting from the abbreviated provision of article no. 46 from Law no. 8/1996 concerning the ordering agreement, the author analyzes from a critical point of view these provisions in relation to other provisions comprised within the special law, and also to those by the Civil code (Law no. 287/2009). The legal provisions referred to herein are digested by means of exemplifying case studies from internal, and European jurisprudence. Therewith, the author emphasizes the controversial points of view from the professional community belonging to well-known writers, and subsequently states personal opinions regarding the approached subjects.
  • The author carries out a detailed analysis of the legal content of the offense to establish an organized criminal group, referred to in art. 367 of the new Criminal Code. After characterizing the concepts of criminalization and the aspects of novelty in the text of art. 367, under the rules in force, are examined in detail: object of criminal protection, subjects, objective and subjective side, forms, terms and punishments stipulated by law. Complementary explanations address the links of this criminal offense with other crimes, and certain procedural aspects. Then, this incrimination rule legislative precedents and the solutions to be followed in case of transitional circumstances are highlighted. Also, the author does not hesitate to express his point of view regarding the constituent content of this criminal offense, its systematization, its nature, and to frame some solutions and ideas of his own in this regard. The end of this analysis presents several conclusions and proposals concerning the law that is to come into force regarding the setting out of the appropriate protection of social values this incrimination concerns, a uniform application of the purport and thus better administration of criminal justice in Romania.
  • Plea of breach of the contract which was unregulated in the previous Romanian Civil Code (of 1864) is expressly established in the new Romanian Civil Code (entered into force on 1 October 2011) in the two paragraphs of art. 1556 stating that, under the rule of the previous Civil Code, legal doctrine and jurisprudence have regained the role of developing the general theory concerning the plea referred to above. Given the above, the author of the study analyzes in detail: the definition, historical development and comparative law issues relating to the plea of breach of contract, the conditions for exercising this plea and its effects and, in the end, she also makes brief conclusions.
  • Intellectual work originality is the essence of copyright. But in fact, the level of assessment for the condition of originality – in consideration of granting protection – is a sensitive, fluid, controversial, and interpretable issue, etc. In the light of international and Romanian copyright legislation, this study aims to clarify a number of difficult issues, controversies regarding the literary work’s originality.
  • Personality’s rights are non-patrimonial rights, inherent to the natural person, in the sense that they are directly attached to and inseparable from the real man, and they serve to the free development of his personality. The new Civil Code regulates the following rights of the personality: right to life, right to health, right to physical and mental integrity, right to dignity, right to respect for private life, right to his own image, identification attributes of the natural person, and the right to dispose of oneself. They can be grouped in two categories: rights that protect the human body and its biological functions, and rights that protect moral values. The first category of rights is governed by three principles: the principle of inviolability of the human body (which may suffer certain exceptions); the principle of non-patrimoniality of the human body, and the principle of the priority of interest and of the good of the human being. The rights which protect moral values have a content determined by their relation to a series of generic notions, incompatible with a precise definition, such as freedom, honor, private life, respect, for which reason the Romanian lawmaker strove to contour such notions; as well as by the regulation of some of the deeds which may impair such rights. Some of the personality’s rights may suffer limitations, which are imposed either by the necessity to protect some major public values, or by the exercise of other persons’ similar rights.
  • The transfer of procedures in penal law represents a form of international judiciary cooperation, which entails the voluntary and provisional waiver by a State of its exercise of its own penal jurisdiction in favor of another State. The authors’ approach targets the determination of the legal treatment of the transfer of procedures in penal law, with a special reference to the procedural acts entailed by the delivery and takeover of penal procedures, as basic forms of such institution, as well as of its legal effects.
  • Democrația ca formă de organizare și de conducere a societății trebuie să se adapteze la noile realități impuse de tehnologia digitală, mai ales printr-un anumit tip de revoluție educativă și culturală în serviciul utilizatorilor. Așadar, democrația în epoca digitală presupune, în primul rând, recunoașterea unui drept fundamental de acces la spațiul digital pentru a se evita în acest mod riscurile unei rupturi digitale, în sensul utilizării acestuia de un număr restrâns de oameni – o elită cibernetică –, implicând toate avantajele ce ar rezulta pentru aceasta din folosirea rețelelor de informare și de comunicare, cum ar fi, de pildă, internetul. Prin urmare, beneficiile unei societăți cibernetice nu sunt reale decât dacă instrumentele informatice sunt pe larg difuzate și puse la dispoziția unui număr cât mai mare de indivizi umani. Într-adevăr, o e-democrație sau o e-administrație nu vor fi inovații relevante decât dacă un număr foarte mare de cetățeni va avea acces facil la acestea.
  • The study intends to present the doctrinal opinions regarding the definition of the prejudice, which represents a condition and measure of the civil liability, the tripartite classification of the prejudices into patrimonial, extra-patrimonial and bodily harm and the indissoluble connection with the concepts of reparation, compensation and indemnification, the own identity of the bodily harm and the ambivalent character of the reparation, either patrimonial and non-patrimonial. It aims to analyze the particularities of the three categories of prejudices, the personal and rebound character of the bodily harm, the conditions for the reparation of the patrimonial prejudices, the certain character of the prejudice and the mitigation of this requirement in the case of the prejudices caused by the loss of a chance, the direct character of the prejudice in correlation with the direct and indirect causal link, the personal and reasonably predictable character of the prejudice, the principle of full reparation of the prejudice and mora creditoris, as a cause of limitation of the debtor’s liability, the guilt, condition of the liability for the reparation of the prejudice. The author also analyzes the presumption of guilt in the contracts generating the obligations of result and the proof of guilt in the contracts generating the obligations of means, as well as the causes exonerating the liability, the classification of damages into compensatory and moratorium damages, the problem of cumulating the damages with the contractual remedies, the cumulation of the damages with the execution of the contractual obligations, of the cumulation of the damages between them and the foundation of their non-cumulation, the judicial evaluation of the damages and their updating, the sanctioning character of the penalizing interest related to the cash claims.
  • Prin instituirea Uniunii Europene, statele au limitat drepturile lor suverane în anumite domenii și au acceptat competența acesteia (exclusivă, partajată sau de a întreprinde acțiuni de sprijinire, coordonare sau completare a acțiunii membrilor). Față de reglementările europene specifice executării silite1, Directiva 93/13/CEE a Consiliului din 5 aprilie 1993 privind clauzele abuzive în contractele încheiate cu consumatorii2 nu prevede expres aplicabilitatea în cursul acestei etape a procesului civil. Cu toate acestea, Curtea de Justiție a Uniunii Europene a stabilit în jurisprudența sa3 că Directiva trebuie avută în vedere de instanțele naționale și în anumite litigii vizând executarea silită, pentru a fi verificat caracterul potențial abuziv al unor clauze în sensul acestui act normativ.
  • Potrivit art. 10 C.pr.pen. alin. (1), părțile și subiecții procesuali principali au dreptul de a se apăra ei înșiși sau de a fi asistați de avocat; în alin. (2) al aceluiași articol se prevede că părțile, subiecții procesuali principali și avocatul au dreptul să beneficieze de timpul și înlesnirile necesare pregătirii apărării; apoi, în alin. (3) se arată că suspectul are dreptul de a fi informat de îndată și înainte de a fi ascultat despre fapta pentru care se efectuează urmărirea penală și încadrarea juridică a acesteia. Inculpatul are dreptul de a fi informat de îndată despre fapta pentru care s-a pus în mișcare acțiunea penală împotriva lui și încadrarea juridică a acesteia, [...]; în sfârșit, în alin. (5) se prevede că organele judiciare au obligația de a asigura exercitarea deplină și efectivă a dreptului la apărare de către părți și subiecții procesuali principali în tot cursul procesului penal.
  • The present study aims to present a series of case law decisions in which the role and the activity of the central bank has proved to be insufficiently considered in depth by the Romanian courts. The application thereby, as regards the National Bank of Romania, of some legal provisions addressed to commercial banks, confusing the administrative review on the acts of the central bank with the administrative jurisdiction, overlapping restraints of the constitutional frameworks in which the National Bank has activated throughout its history, inconsistencies with the vision accepted at European level regarding the attributions and independence of the central banks are widely treated in an attempt to clarify the specific position that the central bank holds in the Romanian institutional landscape. There were presented some solutions from the judicial practice that highlight the need for doctrinal clarifications regarding the nature of the activity of the central bank, including from the European perspective. The importance of knowing them is determined by the significant effects that the correct or incorrect application of the norms and principles regarding the central bank can produce not only at the level of the administrative law, but also at criminal or economic level.
  • One of the most controversial institutions of Romanian criminal procedural law is the institution of exclusion of evidence. We considered it necessary to carry out this comparative law study so that law practitioners as well as any interested person could observe how this institution appeared and how it is applied in other countries and in the case law of the European Court of Human Rights.
  • The author notes that the right to retirement implies two prerogatives of a different nature: belonging to a professional status, part of the individual’s personality (professional or social) and the power to request and receive a monthly money allowance, a patrimonial component. In relation to the theoretical premise stated, it was set the moment of the birth and efficiency of the law, as well as the legal regime of the magistrates’ service pension; we are dealing with a right affected by a double modality: a suspensive condition consisting of three cumulative elements (age, seniority in the judiciary and deontological conduct) and a suspensive term. The applied model, deduced from the concept of civil obligation, then indicates the limits in which the new law may affect the magistrates’ pension, as a result of governmental contribution or gratuity; the theoretical approach offered solutions to indicate the limits within which magistrates’ pension rights can be limited, abolished or taxed.
  • Având în vedere că reclamanții au solicitat desființarea unor acte de reconstituire a dreptului de proprietate privată pe calea acțiunii prevăzute de art. III din Legea nr. 169/1997, Curtea a constatat că, în lipsa unor norme de stabilire a instanței competente în cuprinsul acestei legi speciale, se va aplica Codul de procedură civilă. Dat fiind obiectul cererii (constatarea nulității absolute parțiale a unui titlu de proprietate emis în temeiul Legii fondului funciar nr. 18/1991), Curtea a constatat că, sub aspectul determinării instanței competente, se aplică criteriul valoric, astfel că prezentul conflict urmează a fi soluționat în raport de pragul legal de 200.000 lei, prevăzut la art. 94 pct. 1 lit. k) C.pr.civ. Determinarea instanței competente material în cazul cererilor imobiliare se face doar prin raportare la dispozițiile art. 104 C.pr.civ., nu și la prevederile art. 31 alin. (2) din Ordonanța de urgență a Guvernului nr. 80/2013, întrucât acestea din urmă nu instituie reguli speciale de competență, ci cuprind norme de stabilire a cuantumului taxei judiciare de timbru.
  • Potrivit art. 404 alin. (4) C.pr.pen., dispozitivul trebuie să mai cuprindă, după caz, cele hotărâte de instanță cu privire la: ... g) restabilirea situației anterioare; i) rezolvarea oricărei alte probleme privind justa soluționare a cauzei. Conform art. 25 alin. (3) C.pr.pen., instanța, chiar dacă nu există constituire de parte civilă, se pronunță cu privire la desființarea totală sau parțială a unui înscris sau la restabilirea situației anterioare săvârșirii infracțiunii (cu notă parțial aprobativă).
  • Protecția drepturilor omului1 , în esența sa, a fost la început o afacere internă a statelor și era asigurată într-un cadru național. Treptat, ea și-a făcut loc și în dreptul internațional, care a început să se intereseze de drepturile persoanelor în prima jumătate a veacului trecut, urmare a unor evenimente, cum ar fi revoluția rusă, genocidul asupra poporului armean, ascensiunea la putere a partidului nazist în Germania, ce au determinat mișcări forțate de populație. Era în firescul lucrurilor ca primele instrumente internaționale de protecție a persoanelor să se refere cu precădere la drepturile refugiaților și la drepturile minorităților. În legătură cu drepturile refugiaților, cu titlu de exemplu, relevăm: Aranjamentul privind eliberarea de certificate de identitate refugiaților ruși și armeni din 12 mai 1926; Aranjamentul relativ la statutul juridic al refugiaților ruși și armeni din 30 iunie 1928; Convenția asupra statutului internațional al refugiaților din 28 octombrie 1933; Convenția privind statutul refugiaților provenind din Germania. Cu referire la drepturile minorităților, amintim: tratatele speciale – (de)numite despre minorități – care au fost încheiate în urma Primului Război Mondial cu Polonia, Cehoslovacia, Statul Sârbo-Croato-Sloven, România și Grecia. Pe de altă parte, dispoziții în favoarea minorităților au fost inserate și în tratatele de pace încheiate cu Austria, Bulgaria, Ungaria și Turcia.
  • One of the most controversial institutions of Romanian criminal procedural law is the institution of exclusion of evidence. We considered it necessary to carry out this comparative law study so that law practitioners as well as any interested person could observe how this institution appeared and how it is applied in other countries and in the case law of the European Court of Human Rights.

  • Are separate opinions necessary? Writing them involves both time and resources, and the result does not influence the causes in which they were formulated. In this context, the logical question is why some national and international judges choose to formulate such opinions. We appreciate that the main reason is the potential of these opinions to contribute to the development of the future judicial practice. The aim of this study is to emphasize the importance and benefits of regulating the separate opinions in national legislation and to encourage their use. In this study we aim to analyze the purpose of the separate opinions along with the arguments for and against their regulation in national legislations. We will also analyze the difference between separate and concurring opinions, but also the different result that these opinions may have. We will also address the issue of the style in which these opinions are written and the impact it may have on future case law. A distinct part of this paper will be devoted to the analysis of separate opinions in national courts. At the same time, we will follow if there are differences between the constitutional court and the common law courts, regarding the use of these opinions. At the end of the study, we will make some proposals de lege ferenda on the need for legislative development of the field of separate and concurring opinions, development which would encourage their use and, at the same time, would limit the purpose of using these opinions to the development of the case law.
  • The present paper aims to analyze extensively the institution of commitment of the responsibility of the Government before the Parliament, trying to identify possibilities to improve the current constitutional regulation in Romania. For this purpose, in a first part of the paper, in order to better understand the resources of the institution, the comparative method is used. Thus, similar regulations from other states are widely presented, such as the vote of confidence in a number of parliamentary regimes (United Kingdom of Great Britain and Northern Ireland, the Federal Republic of Germany, the Fourth French Republic), as well as the regulation of the commitment of the responsibility of the Government in the current French semi-presidential regime. Subsequently, the paper focuses on the regulation of the institution of commitment of the responsibility in Romania, being studied the manner of application thereof by the Government in the last 30 years. Several perspectives are used for this purpose: that of doctrine, an occasion that allows the presentation of arguments for and against the current regulation of the institution; that of constitutional practice, which allows the understanding of some disfunctionalities of the current regulation; and, finally, that of the constitutional case law developed in the last three decades, on which occasion it can be deduced a complex theory developed by the constitutional court regarding the limits of the use of the institution. At the end of the paper, a series of proposed amendments are analyzed on the occasion of various attempts to revise the Romanian Constitution and an extensive set of proposals on improving the current regulation is presented. As a consequence, the present paper provides a starting point for the future use of the institution of commitment of the responsibility of the Government, but especially for the improvement of the current constitutional regulation.
  • According to the legal provisions in force, public institutions and authorities (ministries and other specialized bodies of the central public administration) are obliged by the law to ensure their effective security and protection. Also, the security of the objectives of special importance for the defence of the country and for the activity of the state is provided by gendarmes, which have military status. Although the presence of military personnel in public institutions and public authorities is a requirement imposed by the law in order to protect the premises of the institutions, the measures taken by the authorities for managing the SARS-CoV-2 coronavirus pandemic determined, inter alia, a substantial involvement, superior to the one existing in normal conditions, of the military personnel. More specifically, they were part in the actions of the public order bodies of vigilance regarding the observance of the restrictions of movement imposed on the occasion of the establishment of the state of emergency and subsequently the state of alert, as well as in the protection of the public authorities. This aspect translates into a significant increase of the numerical presence of military personnel in everyday life. Without being exhaustive, this study aims to analyze the jurisprudence of military courts on how the provisions on the offence of violation of guard and security duty were interpreted and applied, an analysis which revealed some problematic issues in terms of predictability and accessibility of legal provisions.
