Presumptions represent inferences derived from a known fact to prove an unknown fact, where a close connection exists between the two. These benefit from significant regulation in the matter of possession, to which they indirectly provide substantial legal protection.
Presuming the status of possessor for the individual who holds the asset, followed by the presumption of the possessor’s status as owner, which is succeeded, in turn, by the presumption of the existence of a title of ownership held by the possessor – opposable to third parties – are several resonant examples of presumptions applicable in possessory matters.
The study is dedicated to conceptualizing the terms „possession” and „presumption” and to discerning the legal effects created within the scope of possession by legal, procedural, or substantive presumptions.
