Descriere
The presidential injunction constitutes one of the most flexible and effective procedural instruments of civil procedural law, designed to address urgent, provisional situations without prejudging the merits of the case. Technological developments over recent decades, accelerated by the digitalization of justice, nevertheless call for a conceptual re-evaluation of this institution, both in terms of its traditional admissibility requirements and its practical function within the framework of new social and legal realities.
This paper examines the presidential injunction through the lens of digital transformation, highlighting the challenges and opportunities that the digital era brings to this special procedure.
