The immigration policy is one of the most important policies of the European Union, because, on one hand, it rises problems that the States cannot overcome alone and, on the other hand, due to the
freedom of movement without cheks at the borders between the States, the third-country nationals may circulate freely from one State to another and this is not wanted by the States. This policy refers, among others, to international protection seekers. In 2024 the Union has renewed its “package” of normative acts (among them the regulation in question) in the matter of the international protection seekers, replacing the existing directives with regulations (except one case, in which a new directive has been adopted). The shift from directives to regulations is very important, considering the nature of the directives and of the regulations: the directives are acts which establish only the goal to be attained and must be implemented on the national plane through acts which establish the means of attaining the goal, while the regulation are acts which establish all the aspects to be regulated and which, for this reason, do not need implementation, they being directly and uniformly applied in all the Member States. In this way, the Union marks its will to establish uniform rules for all its Member States in the sensitive field of the migration, aiming at preventing the so-called secondary moves fo the applicants for protection (i.e. the moves in another State than that responsible for the granting of the protection and the lodging of the applications in that another State).
